What is the TN NAFTA Professional?
The North American Free Trade Agreement (NAFTA) created special economic and trade relationships for the United States, Canada and Mexico. The TN nonimmigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level.
Among the professionals eligible to seek admission as TN nonimmigrants are accountants, engineers, lawyers, pharmacists, scientists, and teachers.
You may be eligible for TN nonimmigrant status, if:
- You are a citizen of Canada or Mexico.
- Your profession qualifies under the regulations.
- The position in the United States requires a NAFTA professional.
- You have a prearranged full-time or part-time job with a U.S. employer (but not self-employment); and
- You have the qualifications to practice in the profession in question.
How to apply for the TN NAFTA Professional?
With the right evidence and supporting material, applying for the TN Visa is a fairly straightforward process:
1. Provide Evidence of a Job Offer
In Mr. R.’s case, his employer provided a job offer letter outlining the terms of their agreement as required for the TN visa.
2. Case Compilation and DS-160 visa application
Mr. R’s documents included the completion of a DS-160 visa application, an attorney cover letter, job offer letter, credentials, etc.
3. Submit Visa Application
As a Canadian national Mr. R is entitled to apply for the TN visa at the port of entry without needing to present to a U.S. consulate. We prepared Mr. R. who presented himself and was granted the TN visa for three years without issue!
