Overcoming Inadmissibility: Adjustment of Status Approved After Waiver
Initial Situation & Challenges
Our client, Client D, was eligible to adjust her status in the United States due to her marriage to a U.S. citizen and her lawful entry into the country. In 2022, we filed an Adjustment of Status application on her behalf, along with an I-130 family petition.
Unfortunately, Client D was faced with an unexpected family emergency and had to return to Mexico while her application was still pending. Because her departure occurred after a period of unlawful presence in the U.S., her case faced serious complications. She was now subject to a bar of inadmissibility, making the path forward much more difficult
Our Strategy
In October 2024, we refiled her Adjustment of Status application. Given Client D’s circumstances, our firm decided to handle her case pro bono. She received an interview notice for June 5, 2025. At the interview, the immigration officer explained that an I-601 Waiver was required to overcome her inadmissibility due to her prior unlawful presence.
Soon after, we received a Notice of Intent to Deny (NOID). Our team promptly responded on July 9, 2025, addressing the issues raised by USCIS. We then filed Client D’s I-601 Waiver on July 28, 2025. Just days later, on August 6, 2025, the waiver was approved. With the inadmissibility issue resolved, Client D’s Adjustment of Status was officially granted on August 7, 2025.
The Outcome
Both her I-601 waiver and her I-485 application were approved in just five days, allowing Client D to become a lawful permanent resident of the United States. This rapid approval resolved years of uncertainty and ensured she could remain with her family and continue building her future here.
