When an undocumented child is brought to the United States without inspection, they may be granted Deferred Action for Childhood Arrivals (DACA) status, however, this status being temporary in nature, may present challenges for their immigration status in their adulthood.
This was the case for Ms. C, a Mexican national with DACA status, who retained DeMine immigration due her inability to adjust her status in the United States after marrying an U.S. citizen.
Our Strategy
In Ms. C’s case, the underlying restraint to changing her status, was no valid record of her entry in the United Stated, thus she needed a way to exit and re-enter the country without being denied at the border.
As a DACA recipient, Ms. C is eligible to apply for advance parole for humanitarian reasons. Thus, based on Ms. C’s many family members who suffered from medical problems in Mexico she has not visited in a while, we applied for advance parole.
Once approved, Ms. C travelled to Mexico and upon her return to the U.S., she was inspected by the immigration officer. With a valid entry and a U.S citizen spouse filing a petition for her, Ms. C became eligible to adjust her status in the U.S.
Through strategic analysis of the law and Ms. C’s case, our firm was able to create a pathway for Ms. C’s legal status. We’re pleased to announce Ms. C is a few months away from being granted lawful permanent residency status.
