Charting Success: Filing a Petition for a Multinational Executive

Embarking on the journey of obtaining lawful status through business ownership can be complex yet rewarding.

Today, we share a success story from our experience at DeMine Immigration Law Firm, where we recently assisted a Canadian national, Mr. C, in achieving his goal of gaining lawful status based on his extensive business ownership.

Mr. C, a visionary entrepreneur, owns several thriving restaurants both in Canada and Southwest Florida. Recognizing the potential for growth in the U.S., he sought our assistance in navigating the complexities of immigration law to establish his presence here.

Our strategy involved exploring the I-140 employment-based petition for multinational executives. But who exactly qualifies as a multinational manager or executive? Simply put, it's a foreign national who has demonstrated at least one year of continuous employment in a managerial or executive capacity by a related entity overseas, and who intends to work in a similar capacity in the U.S.

We meticulously presented Mr. C's case, highlighting his extensive experience in the restaurant industry and positioning him as a prime candidate for the EB-1 employment-based preference category. Our dedication was evident in the thoroughness of our petition, comprising nearly 400 pages of supporting documents.

However, navigating the immigration process isn't always smooth sailing. Despite our initial efforts, USCIS issued a 10-page Request for Additional Evidence (RFE). Yet, undeterred, we rose to the challenge, meticulously preparing a response packet with over 300 pages of additional supporting documentation.

After several months of perseverance and collaboration, we're thrilled to announce that Mr. C's I-140 petition was approved! This milestone not only marks a significant achievement for Mr. C but also signifies a crucial step towards realizing his dreams of residency in the United States.

With the approval in hand, Mr. C now has a clear pathway to residency, allowing him to file his adjustment of status before USCIS.
