# Can I Amend My I-751 from Joint Filing to a Waiver After Divorce? USCIS Guidelines Explained

### Understanding the I-751 and Conditional Residency

Our client, Ms. H., was granted conditional residency in the United States and had jointly filed with her U.S. citizen spouse to remove the conditions of her residency. The form for this process is called the I-751. In her original filing, Ms. H. included evidence of a lawful marriage between her and her spouse.

However, the current processing time of the I-751 is around 3-4 years. During this time, the couple divorced, which led Ms. H. to contact DeMine Immigration for assistance.
